Australia has tightened its student visa rules, restricting certain temporary visa holders from applying for a Student visa while in the country and narrowing the circumstances in which international students can include family members in their applications.
The changes took effect on October 2, 2026, and affect prospective international students seeking to switch from other temporary visas to a Student visa (subclass 500), according to travel news outlet Travelobiz.
Under the revised rules, most temporary visa holders can no longer apply for a Student visa from within Australia. Existing Student visa holders are also generally restricted from applying for another Student visa onshore, unless they qualify for an exemption.
The changes could affect people planning to transition from Working Holiday Maker or Skills in Demand visas to student status, potentially requiring them to apply from outside Australia.
Who is Exempt From Australia’s New Student Visa Restrictions?
The revised rules provide exemptions for certain categories of applicants, including students sponsored by Australia’s Department of Foreign Affairs and Trade (DFAT) or Department of Defence.
Other exemptions cover applicants pursuing doctoral degrees, primary or secondary school studies, and students whose education providers cannot deliver their courses.
Students who need up to 12 additional months to complete their courses with the same education provider may also qualify for an exemption. The rules further cover some students who have completed their principal course and intend to progress to a higher-level qualification.
The exemptions mean that the restrictions will not apply uniformly to every international student or temporary visa holder. Applicants will need to establish whether their circumstances fall within the permitted categories before deciding where to lodge their applications.
The changes do not automatically invalidate Student visas that have already been granted.
Applications submitted before October 2, 2026, will also be assessed under the rules that applied when they were lodged, according to Travelobiz.
This distinction is important for international students who had already submitted applications before the changes took effect, as well as those currently studying in Australia under existing visa conditions.
Australia Narrows Family Inclusion Rules
Australia has also restricted the circumstances in which international students can include family members in initial or subsequent Student visa applications.
Exemptions apply to doctoral students, nationals of Pacific countries and ASEAN member states, recipients of fully funded foreign government scholarships, and students sponsored by DFAT or the Department of Defence.
International students who do not fall within these categories may face additional restrictions when planning to bring spouses or children to Australia.
