Australia Tightens Student Visa Rules to Curb ‘Visa Hopping’

Australia has tightened its student visa rules, introducing new restrictions designed to prevent international students from repeatedly switching courses or visa categories to extend their stay in the country.

The measures, which took effect on October 2, 2026, target what the Australian government describes as “visa hopping” and are aimed at limiting the use of successive temporary visas as an informal long-term migration pathway.

Lower-level Course Switching Restricted

Under the new rules, international students already in Australia cannot simply move from a higher-level qualification to a lower-level course to obtain additional time on a Student visa.

The government has particularly closed pathways that previously allowed students to enter Australia for higher education and subsequently switch onshore to Vocational Education and Training (VET) courses.

From July 1, 2027, students seeking to change education providers will also generally need to obtain a new Student visa through a dedicated transfer stream.

For non-school students, the period during which they are generally expected to remain with their principal education provider has temporarily increased from six months to 12 months until June 30, 2027.

New Requirements for Further Study

Students who complete a course and want to continue studying in Australia will generally be required to progress to a higher level under the Australian Qualifications Framework (AQF).

The government has provided exemptions for certain circumstances, including PhD study, school education, provider defaults and cases where additional time is genuinely required to complete an existing course.

The new rules also change where Student visa applications can be made.

Most new Student visa applications must now be lodged from outside Australia, although limited exemptions remain for eligible applicants.

Temporary visa holders, including Working Holiday Maker and Skills in Demand visa holders, can no longer routinely switch to a Student visa while remaining in Australia.

The government’s crackdown extends beyond international students to migration agents and lawyers involved in visa applications.

Assistant Minister for International Education Julian Hill said the government would target migration agents and lawyers who assist with applications that have little prospect of success. The focus includes cases where repeated visa applications and appeals are allegedly used to prolong an individual’s stay in Australia.
